The genesis of this case on appeal is the filing of an action of ejectment by the Intestate Estate of the Fahn Kai Korroh, appellee, before the Civil Law, Sixth Judicial Circuit for Montserrado County, Republic of Liberia, against the Intestate Estate of Konjah Comman, appellant, during the June Term, A.D. 2013. The complaint filed by the appellee alleged as follows:
These certiorari proceedings are before us on appeal from the Ruling of our distinguished Colleague, Mr. Justice Yussif D. Kaba, the Justice presiding in Chambers during the March A.D. 2019 Term of this Honorable Court.
The issue determinative of this case is whether or not in view of the facts and circumstances obtained therein, is the appeal dismissible as a matter of law?
This Court by answering this singular issue will take recourse to the certified records transcribed to it to provide a clear narrative that will form the basis for our judgment.
On July 5, 2018, Attorney Isaac Jackson (petitioner), filed this petition for the writ of prohibition before our Colleague, Her Honor Jamesetta H. Wolokolie then presiding in Chambers, against the Liberia Maritime Authority (LMA) and the Government of the Republic of Liberia, represented by the Minister of Justice/Attorney General (respondents).
On May 25, 2020, the Republic of Liberia, by and through the Ministry of Justice (“informant”) instituted this bill of information against Her Honor Mardea Chenoweth, Resident Circuit Judge, 13th Judicial Circuit Court, Margibi County (“1st respondent”) and Oliver Dillon of the City of Monrovia ( “2nd respondent”) .
