In the instant appeal, the Supreme Court en bane, is called upon to review the Ruling of the Justice presiding in Chambers, Madam Justice Jamesetta H. Wolokolie during the October Term 2019.
Our distinguished colleague, Mr. Justice Joseph N. Nagbe, then Justice presiding in the Chambers of this Court sitting in its March Term, A.D. 2019, entertained and granted a petition for a writ of prohibition filed on the 5th day of April, 2019 by the Liberia Petroleum
This case involves two separate petitions of prohibition filed before our distinguished Colleague, Mr. Justice Joseph N. Nagbe.
On July 5, 2018, Attorney Isaac Jackson (petitioner), filed this petition for the writ of prohibition before our Colleague, Her Honor Jamesetta H. Wolokolie then presiding in Chambers, against the Liberia Maritime Authority (LMA) and the Government of the Republic of Liberia, represented by the Minister of Justice/Attorney General (respondents).
On September 26, 2019, Mr. Justice Yussif D. Kaba, Associate Justice then presiding in Chambers, having entertained arguments pro et con, on a petition for the writ of prohibition, ruled thereon, granting the petition in favor of the appellee herein, the Intestate Estate of Kwia Nyene Howe.
We further hold that as at the time of the filing of the writ of prohibition, the House of Representatives had done nothing in violation of the due process right of the petitioner to warrant the granting of the writ of prohibition.
